Terms of sale and licence

What you get when you buy a drżysz instrument, what you can do with it, and what to do if something goes wrong.

1. Who we are

drżysz instruments, including mżawka, are made by [full name or company name], [address], [tax ID, if any] ("we"). Contact: digital.forge.contact@gmail.com.

2. How the sale works

Our products are sold by Lemon Squeezy LLC, which acts as the reseller (merchant of record). Lemon Squeezy takes the payment, issues the receipt and charges VAT, and its terms apply to the payment itself. We are responsible for the product: the plugin, its updates, the licence and support.

The price on our website includes VAT. The contract is concluded when Lemon Squeezy confirms your order. You then get a licence key and access to the installer.

3. Your licence

You buy a licence to use the software, not the software itself. After a single payment the licence is yours with no time limit. It includes the updates we release for the product you bought.

• You may activate the plugin on up to two computers that you use yourself. To move it, deactivate it on the old one first (Settings → Manage license).
• You may use it in personal and commercial work: music, sound design, film, games, live shows.
• Everything you make with it is yours. You owe us no royalties and no credit.

4. What isn't allowed

• Sharing, selling or giving away your licence key or the installer.
• Publishing the installer or the plugin files anywhere.
• Decompiling or modifying the software, except where the law expressly allows it.

If these rules are broken, or a payment is refunded or charged back, the licence ends and the key may be disabled.

5. Demo and activation

The free demo is the full plugin. It works for 48 hours from the first time it runs on a computer; after that the sound stays off until a licence key is activated. Activation needs an internet connection once; the plugin then checks the licence about every three days and keeps working offline for 30 days after the last successful check.

Check the system requirements on the product page before you buy. The plugin runs in hosts that support the formats listed there (AU, VST3); we can't guarantee every host and every configuration.

6. Right of withdrawal (consumers in the EU)

A consumer normally has 14 days to withdraw from a distance contract. For digital content delivered right away, this right ends when the download starts, provided you agreed to immediate delivery at checkout and acknowledged that you lose the right of withdrawal. Refunds are processed by Lemon Squeezy. If mżawka doesn't run on your computer and we can't fix it, write to us and we will look for a solution together.

7. If something doesn't work

The plugin must work as described on the product page. If it doesn't, you have the rights the law gives you. Write to digital.forge.contact@gmail.com, describe the problem and add the email you paid with. We reply within 14 days, usually much sooner.

8. Liability

We work hard to make the plugin stable, but keep backups of your projects. To the extent the law allows, we are not liable for lost data, lost profits or indirect damage. Nothing in these terms limits your rights as a consumer or our liability for damage caused intentionally or through gross negligence.

9. Personal data

How we handle personal data is described in the privacy policy.

10. Law and changes

These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. Disputes go to the competent common court. If we change these terms, the new version applies to purchases made after the change.

Regulamin sprzedaży i licencja

Co dostajesz, kupując instrument drżysz, co możesz z nim robić i co zrobić, gdy coś nie działa.

1. Kim jesteśmy

Instrumenty drżysz, w tym mżawkę, tworzy [imię i nazwisko albo nazwa firmy], [adres], [NIP, jeśli jest] („my”). Kontakt: digital.forge.contact@gmail.com.

2. Jak wygląda sprzedaż

Nasze produkty sprzedaje Lemon Squeezy LLC jako sprzedawca (merchant of record). Lemon Squeezy przyjmuje płatność, wystawia potwierdzenie i nalicza VAT, a do samej płatności stosuje się jego regulamin. My odpowiadamy za produkt: wtyczkę, jej aktualizacje, licencję i pomoc.

Cena na naszej stronie zawiera VAT. Umowa zostaje zawarta, gdy Lemon Squeezy potwierdzi zamówienie. Wtedy dostajesz klucz licencyjny i dostęp do instalatora.

3. Twoja licencja

Kupujesz licencję na korzystanie z programu, a nie sam program. Po jednorazowej płatności licencja jest Twoja bez ograniczenia czasu i obejmuje aktualizacje, które wydamy dla kupionego produktu.

• Możesz aktywować wtyczkę na maksymalnie dwóch komputerach, z których sam korzystasz. Żeby ją przenieść, najpierw dezaktywuj ją na starym komputerze (Settings → Manage license).
• Możesz jej używać w pracy prywatnej i komercyjnej: w muzyce, sound designie, filmie, grach i na koncertach.
• Wszystko, co z nią stworzysz, należy do Ciebie. Nie płacisz nam tantiem i nie musisz nas wymieniać.

4. Czego nie wolno

• Udostępniać, sprzedawać ani oddawać klucza licencyjnego lub instalatora.
• Publikować instalatora ani plików wtyczki.
• Dekompilować ani modyfikować programu, chyba że prawo wprost na to pozwala.

Jeśli te zasady zostaną złamane albo płatność zostanie zwrócona lub cofnięta, licencja wygasa, a klucz może zostać wyłączony.

5. Demo i aktywacja

Darmowe demo to pełna wtyczka. Działa przez 48 godzin od pierwszego uruchomienia na danym komputerze, a potem dźwięk milknie, dopóki nie aktywujesz klucza licencyjnego. Do aktywacji potrzebny jest raz internet. Potem wtyczka sprawdza licencję mniej więcej co trzy dni i działa bez sieci jeszcze 30 dni od ostatniego udanego sprawdzenia.

Przed zakupem sprawdź wymagania systemowe na stronie produktu. Wtyczka działa w programach obsługujących wymienione tam formaty (AU, VST3). Nie możemy zagwarantować działania w każdym programie i każdej konfiguracji.

6. Prawo odstąpienia od umowy (konsumenci w UE)

Konsument ma zwykle 14 dni na odstąpienie od umowy zawartej na odległość. Przy treściach cyfrowych dostarczanych od razu to prawo wygasa z chwilą rozpoczęcia pobierania, jeśli przy zakupie zgodziłeś się na natychmiastowe dostarczenie i przyjąłeś do wiadomości utratę prawa odstąpienia. Zwroty obsługuje Lemon Squeezy. Jeśli mżawka nie uruchamia się na Twoim komputerze, a my nie potrafimy tego naprawić, napisz do nas, a razem poszukamy rozwiązania.

7. Gdy coś nie działa (reklamacje)

Wtyczka musi działać tak, jak opisujemy na stronie produktu. Jeśli tak nie jest, przysługują Ci prawa przewidziane w przepisach. Napisz na digital.forge.contact@gmail.com, opisz problem i podaj e-mail użyty przy płatności. Odpowiadamy w ciągu 14 dni, zwykle dużo szybciej.

8. Odpowiedzialność

Dbamy o to, żeby wtyczka działała stabilnie, ale rób kopie zapasowe projektów. W granicach, na jakie pozwala prawo, nie odpowiadamy za utracone dane, utracone zyski ani szkody pośrednie. Nic w tym regulaminie nie ogranicza Twoich praw jako konsumenta ani naszej odpowiedzialności za szkody wyrządzone umyślnie lub przez rażące niedbalstwo.

9. Dane osobowe

Zasady przetwarzania danych opisuje polityka prywatności.

10. Prawo i zmiany

Regulamin podlega prawu polskiemu. Jako konsument zachowujesz ochronę, którą dają Ci bezwzględnie obowiązujące przepisy kraju, w którym mieszkasz. Spory rozstrzyga właściwy sąd powszechny. Jeśli zmienimy regulamin, nowa wersja obowiązuje przy zakupach dokonanych po zmianie.
